PLEASE READ THE FOLLOWING TERMS OF SERVICE VERY CAREFULLY, AS THESE TERMS GOVERN YOUR RIGHTS AND OBLIGATIONS WHEN YOU USE THE SERVICES OFFERED BY CALL PROTECT.
This term is between you, the user, and Call Protect, the service provider. By downloading Call Protect, you acknowledge that you are granted a nontransferable license to use this app, as long as you abide by the terms presented here.By using Call Protect's services, you indicate your acceptance of the following terms and conditions and you agree to abide by these terms. If you do NOT agree with any term on this "Agreement", you must deny these terms by avoiding the use of any of the Call Protect services, including but NOT limited to the Call Protect mobile app.
The terms here may get revised from time to time, whenever needed. All registered users will be notified of any change via e-mail. If you are NOT a registered user, it is your duty to check the latest Terms of Service, before using the service.
User Rights and Responsibilities
All services offered by Call Protect are privileges, NOT rights. You must understand that we grant to you a personal, limited, nonexclusive, nontransferable privilege to use Call Protect. We reserve exclusive rights of ownership. If you are found to violate with any of the policies, Call Protect reserves the right to terminate your user account. If you are an unregistered user, your device will be blocked from using the service. Most of the time, the account termination and device blocking are permanent; however, depending on the case, Call Protect may temporarily block the service to specific users for investigative purposes. For any reason, if Call Protect determines that your usage of our service is detrimental to us, we reserve the right to stop serving you.
By using Call Protect, you agree that you will not use Call Protect in any way that violates any applicable current law or regulations. In addition, you agree NOT to:
- access or attempt to access any account you are not authorized to use
- attempt unauthorized access to Call Protect servers
- scrap or attempt scraping content from Call Protect or modify it in any way
- copy, create, or distribute Call Protect content
- use data provided by Call Protect in any unauthorized way
You also agree NOT to use any information or data you receive through Call Protect for any unlawful purposes, including but NOT limited to: harassing, threatening, or stalking any individual; cyberbullying; using false identity to request information; employment or other screening of individuals without their consent; selling personal information.
By using our services, you agree that you received a phone call or a text message from the number you are looking up.
App Data and Information Usage
As a Call Protect user, you agree and understand that data and information provided by Call Protect are for your personal use only. Any commercial or business use is prohibited. Sharing of data or information provided by Call Protect with any third-party (organization or individual) is prohibited as well.
FCRA Restrictions
Call Protect is not a consumer reporting agency as defined in the Fair Credit Reporting Act ("FCRA"), and the information in the databases used by Call Protect has not been collected in whole or in part for the purpose of furnishing consumer reports, as defined in the FCRA. You shall not use any of the information received from Call Protect as a factor in (1) establishing an individual's eligibility for personal credit or insurance or assessing risks associated with existing consumer credit obligations, (2) evaluating an individual for employment, promotion, reassignment or retention (including employment of household workers such as babysitters, cleaning personnel, nannies, contractors, and other individuals), or (3) any other personal business transaction with another individual (including, but not limited to, leasing an apartment).
Purchase and Registration
The limited services of Call Protect are currently offered for free. The free service gives access to the basic features that are sufficient for most users. Call Protect also offers a PRO subscription to the users that has additional features. If you choose to subscribe to a PRO protection, then the following terms apply:
- You must be at least 18 years of age.
- You can cancel the subscription at any time, but the subscription will stay active up to the end of the current billing period. No partial refund is issued for the unused duration of the subscription.
- For paid auto-renewing subscriptions, you will be charged the amount of the subscription up to 24 hours before the subscription expires.
- If you wish to cancel the subscription, you will have to do it directly from your App Store subscription management utility.
We may ask you to register before we allow you to use some of the services offered by Call Protect. In that case, to register for an account, you agree to provide accurate, current, and complete information. It is your responsibility to keep your account secure by taking all necessary precautions, including but NOT limited to: using a very strong password and using Call Protect only through secured network connections. Call Protect will NOT be responsible, and you agree to indemnify and defend us when any damage or loss is incurred by you or another party due to access to or use of your account. Whenever you suspect of any unauthorized use of your account, you agree to notify us in writing immediately. In case of such events, you agree to fully cooperate with Call Protect to eliminate the issue.
In an event when we determine that your usage of Call Protect is detrimental in any way, we can solely decide to deny access to the app services to you.
Copyright and Trademarks
Call Protect and its licensors own the data and information offered by Call Protect. These data and information may be protected by copyright, trademark, patent, trade secret, and/or other existing laws. You agree NOT to use Call Protect's data in any way that is incompliant with the terms of this policy. If we authorized you to reuse our data for any purpose, you agree NOT to remove or tamper with the copyright notice that comes with the data.
Service Warranty and Limitation of Liability
Even though Call Protect is dedicated to providing latest and reliable information, there may be an event where we are incapable to do so. We use a license from a third-party to retrieve requested data from the database they maintain. These data are provided "as in" without warranty of any kind. Call Protect does NOT guarantee the accuracy of such data, so you must use it only for research purposes. Avoid making decisions solely based on the information you receive by using our Lookup services.
Sometimes, our servers may NOT operate normally. You agree and accept that the service may get interrupted during server outage and maintenance.
Call Protect will NOT be responsible for any financial or physical loss incurred due to inaccuracy of data or service outages.
In some cases, the blocking service may not work effectively, and the calls may go through. If that happens, Call Protect may not be deemed responsible for any consequences.
Disclaimers
Call Protect does NOT warrant or make any representations regarding the use, validity, accuracy, or reliability of the information offered by it. You agree and understand that your use of Call Protect services is completely at your own risk.
CALL PROTECT IS NOT AFFILIATED TO ANY GOVERNMENT OR STATE AGENCY.
Indemnification
You strongly agree to indemnify, defend, and hold harmless Call Protect and its staffs, partners, affiliates, and licensors from any claim or demands made by any third-party based on your use of Call Protect services.
Account and Service Termination
Call Protect reserves the right to suspend or terminate your account for any reason. Such termination or suspension may happen suddenly without any pre-notification. Call Protect cannot be held liable for such terminations or suspensions.
User Data and Cookie Policy
You agree that Call Protect may collect and use technical and other relevant data to improve its products or to provide services or technologies to you.
The following are the information that are normally collected:
- public IP address,
- device token,
- in-app purchase receipts,
- timestamps,
- nature of the device,
- operating system,
- app version,
- and other information you consent us to access during app usage.
If you choose to register for a service, you will need to use your true legal identity for registration. All the data you submit to us are stored in a secure database. Call Protect, under NO circumstances, sells its user's data to a third-party. We may, however, provide your information to Law Enforcement Agency, if they make a valid request.
To personalize your app-use and web-browsing experience, we may set up cookies (a small client-side file used to store user data) and store your information on that cookie.
Warranties
You agree to use Call Protect at your sole risk. The application is provided "as is" and "as available," with all faults and without warranty of any kind. You assume the cost of all necessary servicing, repair, or correction.
Third-Party Advertisements
To be able to offer our services, Call Protect has partnered with online advertisement vendors like Google to serve you advertisements. These advertisements help us generate the revenue needed to keep the app operational. These third-party advertisement vendors, however, may track your behavior through cookies and other mechanisms to improve your experience by serving you with personalized relevant advertisements.
Call Protect participates in Amazon Associates program, so it may promote products sold on Amazon and earn a small commission when users make any purchase.
Change in Terms and Policies
If necessary for any reason, these terms and policies may get updated. If you are a registered user, any change in terms and policies will be notified to you via e-mail. All unregistered users are required to check the latest terms and policies before using our services.
